Professional Indemnity · Medical Malpractice

You look after patients. We'll look after the claims.

Even careful, experienced doctors face allegations of negligence. Professional indemnity insurance pays for your legal defence and any compensation awarded, so a complaint doesn't put your savings or your practice at risk.

  • Legal defence costs covered from the first notice, including consumer-forum and civil-court cases
  • Plans for individual doctors, clinics, nursing homes and hospitals
  • Quotes from multiple insurers, compared for you by an IRDAI-licensed broker

Why it matters

A single complaint can take years to resolve

Medical services fall within India's consumer protection law, and patients today are better informed and quicker to seek redress. Even a claim you ultimately win carries lawyer fees, expert opinions and time away from your practice.

Consumer forums are open to patients

Patients can file a complaint without heavy court fees, so claims are easier to bring and more common than many doctors expect.

Defence is costly and slow

Legal counsel, expert witnesses and appeals add up long before any verdict. Your policy pays these costs as the case progresses.

Hospitals often require it

Many hospitals ask visiting and empanelled consultants to show a valid policy before granting practising privileges.

Coverage

What the policy covers, and what it doesn't

We believe you should know the limits of your cover before you buy it, not when you make a claim.

Negligence claims

Compensation you're legally liable to pay for bodily injury or death arising from an error or omission in your professional services.

Legal defence costs

Advocate fees, expert opinions and court expenses incurred with the insurer's consent, even if the allegation proves groundless.

Consumer forum & civil cases

Defence at district, state and national consumer commissions and in civil courts, including appeals.

Past treatments

Claims made during the policy period for treatment given on or after your retroactive date.

Staff & premises (establishment plans)

Negligence by qualified staff you employ, and third-party injury on your premises, under medical establishment policies.

Extended reporting period

Optional extra time to report claims after your policy ends, useful when you retire or stop practising.

Criminal or deliberate acts

Intentional wrongdoing, fraud, or acts that break the law.

Treatment under the influence

Services given while under the influence of alcohol or drugs.

Outside your qualification

Procedures you aren't qualified or registered to perform.

Known or prior claims

Incidents you knew about before the policy started, or treatment before the retroactive date.

Fines & penalties

Punitive or exemplary damages, fines, and penalties imposed by law.

Guarantees & contractual liability

Promises of a specific outcome, or liability you take on by contract beyond what law imposes.

This is a summary. Exact inclusions, exclusions and sub-limits vary by insurer and plan. Please read the policy wording before you buy; your SafeTree advisor will walk you through it.

Insurance, simplified

Key terms, in plain language

Six things worth understanding before you compare policies.

Limit of indemnity

The most the insurer will pay. Usually set per claim (any one claim) and in total for the policy year (aggregate).

Claims-made basis

The policy responds to claims first made against you while it is active, not to when the treatment happened.

Retroactive date

Treatment given before this date isn't covered. Renew without a gap and it stays fixed, protecting all your past work.

Deductible

The portion of each claim you pay yourself. A higher deductible usually means a lower premium.

Extended reporting period

Extra time after the policy ends to report claims for work done while it was active.

Jurisdiction

Where claims must be brought for the policy to respond. Most Indian policies cover claims filed in Indian courts and forums.

If a claim is made

What to do if you receive a notice

Acting quickly and in the right order protects your cover. Here's how it works with SafeTree.

Inform us immediately

Call or email SafeTree as soon as you receive a legal notice, complaint, or learn of a possible claim.

Share the documents

Send the notice, patient records, consent forms and treatment notes. We'll tell you exactly what's needed.

Insurer appoints counsel

We register the claim with the insurer, who assigns or approves a lawyer experienced in medical cases.

Defence & settlement

Defence costs and any award are paid as per your policy. We keep you updated at every stage.

Important: don't admit liability, offer compensation, or reply to a legal notice before speaking to us and your insurer. Doing so can affect your claim.
FAQs

Questions doctors often ask us

Is professional indemnity insurance mandatory for doctors in India?
It isn't mandated by law for every practitioner, but many hospitals require visiting and empanelled doctors to hold it, and medical services fall within the Consumer Protection Act, 2019. Most practising doctors treat it as essential.
How much cover should I buy?
It depends on your specialty, the procedures you perform and where you practise. Surgical and high-risk specialties such as obstetrics, IVF, anaesthesiology and cosmetic procedures typically need higher limits. Your SafeTree advisor will suggest a limit based on recent claim trends in your field.
What is a retroactive date and why does it matter?
It's the date from which your professional services are covered. A claim is covered only if the treatment it relates to happened on or after this date. If you renew without a break, you keep your original retroactive date. A gap in cover can reset it and leave past work unprotected.
Does my individual policy cover my clinic staff?
No. An individual policy covers you as a practitioner. To cover nurses, technicians and other staff, and the establishment itself, you need a medical establishment policy.
Am I covered if a patient files a complaint after I switch insurers?
Usually yes, as long as your new policy carries over your retroactive date and you disclose any known incidents when you switch. We handle this continuity for you when you move your policy to SafeTree.
Is the premium tax-deductible?
For practising professionals, the premium is generally treated as a business expense. Please confirm how it applies to you with your tax advisor.
How quickly can I get a policy?
Once we have your completed proposal form and registration details, most individual policies can be issued within a few working days.
